A former Mercer County High School ag teacher has pleaded guilty to an amended charge and was sentenced to 10 days in the Mercer County Jail and 24 months of second-chance probation in an inappropriate messaging investigation.
Last week, 27-year-old Brandon Livingston pleaded guilty to a Class 4 felony of disorderly conduct. As part of the plea, his original charges of a Class 3 felony of official misconduct and a Class A misdemeanor of distribution of explicit material to a minor were dismissed.
Livingston was also fined $2,000 as part of the sentence.
Second-chance probation allows a pathway for first-time offenders to have their charges dismissed upon successful completion of the probation period.
Livingston was arrested in October 2024. At the time of his arrest, the Mercer County Sheriff’s Department said it “received a complaint on Oct. 28, 2024, regarding seemingly inappropriate text messages that were sent to a minor.”
Livingston was initially placed on paid administrative leave by the Mercer County School District, but eventually resigned from his teaching position.
