Mercer County Teacher Resigns, Awaits Trial In Inappropriate Text Messaging Case

A Mercer County High School ag teacher arrested in an inappropriate text messaging investigation, has resigned. Brandon Livingston’s resignation was accepted by the Mercer County Board of Education Wednesday.

The 27-year-old Livingston will return to Mercer County Circuit Court March 17. He faces a Class 3 felony of official misconduct and a Class A misdemeanor of distribution of explicit material to a minor. He has pleaded not guilty to the charges.

Livingston was arrested last fall. In a press release, the Mercer County Sheriff’s Department said it “received a complaint on Oct. 28 regarding seemingly inappropriate text messages that were sent to a minor.”

Livingston was granted pre-trial release following his initial court appearance in October.
