A Mercer County High School teacher has waived his preliminary hearing in a criminal case. 26-year-old Brandon Livingston is facing a Class 3 felony of official misconduct and a Class A misdemeanor of distribution of explicit material to a minor. He has pleaded not guilty to the charges.
Livingston was arrested late last month. In a press release, the Mercer County Sheriff’s Department said it “received a complaint on Oct. 28 regarding seemingly inappropriate text messages that were sent to a minor.”
The school district has placed him on administrative leave.
Livingston was granted pre-trial release following his initial court appearance last month. A pre-trial conference has been scheduled for Jan. 6.
