Suspect Injured In Mercer County Officer Involved Shooting Has Another Court Continuance

The man shot by a Mercer County Sheriff’s Deputy during a weapons investigation last year has had his case pushed back in federal court.  29 year old Donovan Smith of Sherrard is facing two counts of unlawful transport of firearms stemming from a June 12th incident in the Viola area.  He was shot by an officer during the investigation with the shooting eventually ruled justified by the Mercer/Henry County Major Crimes Task Force.  Smith’s case was continued to April 23rd this week at U.S. District Court in Davenport.  A co-defendant in the case, 29 year old Alex Cady of Preemption pleaded guilty to a state charge of armed violence last October and was sentenced to 15-years in prison. He has since filed a motion to withdraw his guilty plea with a hearing scheduled for April 9. Smith remains in U.S. Marshals Service custody. Cady is serving his sentence at the Hill Correctional Center in Galesburg.
