Sherrard Man’s Weapons Case Moved To Next Year In Federal Court

The man shot by a Mercer County Sheriff’s Deputy during a weapons investigation has had his case pushed to next year in federal court.  28 year old Donovan Smith of Sherrard is facing two counts of unlawful transport of firearms stemming from a June 12th incident in the Viola area.  He was shot by an officer during the investigation with the shooting eventually ruled justified by the Mercer/Henry County Major Crimes Task Force.  Smith’s case was continued to January 30th this week at U.S. District Court.  A co-defendant in the case, 29 year old Alex Cady of Preemption pleaded guilty to a state charge of armed violence last month and was sentenced to 15-years in prison.  Smith remains in U.S. Marshals Service custody.
