The man accused of beating up and robbing Fred Rooth at his rural Joy farmhouse has waived his preliminary hearing. 55 year old Brian Tully of Burlington made a brief appearance in Mercer County Circuit Court this morning. A pre-trial conference has been scheduled for August 22nd. He faces home invasion, residential burglary and aggravated battery charges stemming from the May attack on Rooth. Tully is also charged with crimes in Henderson and Warren Counties. He was arrested last week and remains in the Mercer County Jail on $200,000 bond.
